Heally Patient Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Heally platform, including the website located at portal.getheally.com and any related websites, applications, or services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. What Heally Is (and Is Not)

Heally, Inc. ("Heally," "we," "us," or "our") provides a technology platform that enables individuals ("Patients," "you," or "Users") to connect with independent, licensed healthcare providers ("Providers") for healthcare-related services.

  • Heally does not practice medicine or any licensed profession.
  • Heally does not provide medical advice, diagnosis, or treatment.
  • Heally does not control or supervise Providers' clinical decision-making.

All healthcare services are provided solely by Providers.

2. Provider-Patient Relationship

Any provider-patient relationship formed through the Platform exists solely between you and the Provider. Providers are independent professionals responsible for all medical services they provide.

3. Telehealth Informed Consent Applies to telehealth use

Some Providers may offer services using telehealth technologies, including real-time audio, video, and secure electronic communications ("Telehealth Services").

By using Telehealth Services, you acknowledge and agree to the following:

A. Nature of Telehealth

Telehealth involves healthcare services delivered when you and the Provider are not in the same physical location.

B. Benefits

  • Improved access to care
  • Convenience
  • Reduced need for travel

C. Risks and Limitations

  • Technical failures may affect care
  • Incomplete information may limit evaluation
  • Small risk of unauthorized access to information

D. No Guarantee of Results

No specific medical outcomes are guaranteed.

E. Appropriateness

Your Provider may determine telehealth is not appropriate and may require in-person care.

F. Not for Emergencies

Telehealth is not for emergencies. Call 911 or go to the nearest emergency room.

G. Voluntary Participation

You may withdraw consent at any time.

H. Services Not Appropriate for Telehealth

Telehealth is generally not suitable for conditions requiring physical examination, diagnostic testing, procedures, or emergency care.

Telehealth consent may also be collected separately via checkbox. This section remains effective regardless.

4. No Medical Advice from Heally

Content on the Platform is for informational purposes only and does not constitute medical advice.

5. Eligibility and User Accounts

You must be 18 or older, or a parent/guardian acting for a minor.

6. Communications

You consent to receive communications from Heally via email, SMS, push notification, or Platform notices.

Message and data rates may apply. Reply STOP to opt out of SMS.

7. Fees and Payments

You agree to pay applicable fees disclosed prior to service. Refund requests may be submitted to support@getheally.com.

8. Privacy and Information Security

Your use of the Platform is subject to Heally's Privacy Policy: https://getheally.com/patients/privacy-policy

9. Acceptable Use

You agree not to misuse the Platform or engage in unlawful conduct.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

11. Limitation of Liability

Heally's liability is limited to the amount you paid to Heally in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold Heally harmless.

13. Arbitration and Governing Law

These Terms are governed by California law. Disputes will be resolved by binding arbitration on an individual basis.

14. Changes to These Terms

Continued use of the Platform constitutes acceptance of updated Terms.
